Cancelling an Energy Contract (Right of Withdrawal)

From the moment you conclude an energy contract, you have the right to cancel it free of charge within 14 calendar days, regardless of how you entered into the contract (whether in a store, at a trade show, online, or through door-to-door sales, etc.).

Remote Sales of Energy Contracts (e.g. by Telephone, Online)

When expressing interest in an energy contract via telephone, internet, or any other remote communication method, the company making the offer must provide the necessary, legally required information in a clear and understandable manner before the contract is concluded. This information becomes an integral part of the potential contract.

Sometimes, salespeople call consumers and guide them to a vendor's website over the phone, ultimately prompting them to click a button that unknowingly results in agreeing to a contract. The law requires that next to the button, there must be a clearly legible statement that clicking it is equivalent to placing an order with a payment obligation.

Off-Premises Sales of Energy Contracts (e.g. Door-to-Door Sales)

In an off-premises sale, the company must provide all necessary, legally required information before the contract is concluded, ensuring it is clear and understandable.

If a seller visits your home without being inviteed, they may not draw up a contract, but only a non-binding offer. You may only confirm that offer after at least three days. Only upon confirmation does the 14-calendar-day withdrawal period begin.

In the case of an unsolicited visit, the seller must also provide you with information, including a model form allowing you to declare that you do not wish to be contacted through door-to-door sales for a period of one year.
